Peterson lawyers argue ownership of gun legal

Drew Peterson's lawyers contend a federal law allows the retired police officer to own a rifle with a shorter barrel.

But Assistant State's Attorney John Connor argues the Law Enforcement Officers Safety Act of 2004 doesn't permit officers to own weapons that would be illegal under state law.

The issue was argued at a hearing Monday before Will County Judge Richard Schoenstedt, who plans to make a decision on a motion to dismiss July 30.

On Friday, a grand jury indicted Peterson, 54, on two counts of the unlawful use of a weapon. The Bolingbrook man is accused of owning a rifle that is shorter than allowed by law. Police seized the gun and others after the October disappearance of Stacy Peterson, 23, his third wife.
