Elgin man gets two years in prison for killing Chihuahua

A 20-year-old northwest suburban man was sentenced to two years in prison for killing his roommate’s Chihuahua after the men argued earlier this year.

Under a plea agreement with Kane County prosecutors, Oscar Guerrero of the 500 block of Lavoie Avenue in Elgin was sentenced to two years in prison after pleading guilty to one count of aggravated cruelty to animals, a release from the Kane County State’s Attorney’s office said.

At about 1:30 a.m. on May 13, Guerrero, who had been drinking according to prosecutors, woke up a roommate and asked him to help with a project. The roommate, who had been sleeping with a Chihuahua named Daisy on the sofa in the living room, refused. The men began to argue and Guerrero grabbed Daisy by the scruff of the neck and threw her at a wall, killing her.

Under Illinois law, Guerrero is eligible for day-for-day sentencing and was given credit for at least 137 days served in the Kane County jail, where he had been held since his arrest on a $50,000 bond.
